In these General Terms and Conditions of Sale, "Nidoulove", "we", "our" and "us" refer to NIDOULOVE LIMITED.

2. Scope of application

These General Terms and Conditions of Sale govern the sale of products on the website www.nidoulove.fr to private consumers residing in France, the European Union and Switzerland, in the countries actually served at the time of the order.

Any order placed on the website implies full and unreserved acceptance of these General Terms and Conditions of Sale.

3. Products

The products offered for sale are described and presented with the utmost care. The photographs, visuals and descriptions are intended to present the items as accurately as possible. Slight differences may, however, exist between the visuals displayed on the website and the product delivered, without affecting its essential characteristics.

4. Prices

The prices displayed on the website are indicated in the currency offered to the customer at the time of the order.

Delivery costs are specified before the final validation of the order.

For orders delivered in Switzerland, Nidoulove is not subject to Swiss VAT. Consequently, any customs duties, Swiss import VAT and customs clearance fees may be required by the competent authorities or by the carrier. Unless otherwise expressly stated, these costs remain the responsibility of the recipient.

Nidoulove reserves the right to modify its prices at any time. However, products are invoiced based on the rate in force at the time of order validation.

5. Order

The customer selects the products they wish to purchase and adds them to their cart. Before final validation, they must check the details of their order, its total price, any additional costs, and the delivery and billing information provided.

The order becomes final after payment confirmation and sending of a confirmation email.

Nidoulove reserves the right to refuse or cancel any order for legitimate reasons, particularly in case of suspected fraud, payment incident, obvious pricing error, stock shortage, or incomplete or incorrect information provided by the customer.

6. Payment

Purchases are paid for using the secure payment solutions offered on the website at the time of ordering, such as credit card, Apple Pay, or any other method displayed during the order process.

The order is only considered definitively accepted after effective payment validation.

7. Delivery

Deliveries are offered in the served areas indicated on the website at the time of ordering, particularly in mainland France, the European Union, and Switzerland, when this destination is available.

Delivery times are indicative. They may vary depending on the destination, carrier, order period, or nature of the products ordered. For deliveries to Switzerland, these times may be extended due to customs formalities.

In case of delays beyond our control, the customer will be informed as soon as possible.

It is the customer's responsibility to check the condition of the package and products upon receipt and to report any anomaly or damage as soon as possible.

8. Right of withdrawal

For customers residing in the European Union, when the legal right of withdrawal is applicable, the customer has a period of fourteen days from receipt of their order to exercise this right, without having to give reasons for their decision.

For customers residing in Switzerland, Nidoulove contractually grants a fourteen-day right of withdrawal from the date of receipt of the order, under the conditions set out in this article.

Returned products must be unused, complete, in perfect resalable condition and, where possible, returned in their original packaging.

Return costs are the responsibility of the customer, unless we are at fault or a defective product has been received.

In accordance with applicable rules, certain products cannot be subject to a right of withdrawal, including personalized items, perishable goods, or opened products that cannot be returned for reasons of hygiene or health protection.

9. Returns and refunds

After receipt of the returned product and verification of its compliance with the return conditions, the refund will be made within a maximum of fourteen days, via the original payment method used for the order, unless expressly agreed otherwise for another refund method.

In the event of a partial return, the refund will only cover the products actually returned under the conditions set out in these General Terms and Conditions of Sale.

10. Warranties

The products sold on the site benefit from the applicable legal warranties, including the legal warranty of conformity and the warranty against hidden defects, when these warranties are provided by the mandatory provisions applicable to the customer.

No provision of these General Terms and Conditions of Sale deprives the customer of the mandatory rights they benefit from under the law applicable in their country of residence.

11. Liability

Nidoulove cannot be held responsible for damages resulting from improper use of the products, use contrary to their intended purpose or non-compliance with precautions for use.

Nidoulove cannot be held responsible for disruptions, interruptions or damages related to the operation of the Internet network, such as service outages, external intrusions, the presence of a virus or temporary unavailability of the site.

12. Intellectual property

All elements present on the site, including texts, photographs, visuals, graphics, logos, design elements and the name "Nidoulove", are protected by intellectual property rights and remain the exclusive property of Nidoulove Limited or their respective owners.

Any reproduction, representation, exploitation or use, in whole or in part, without prior written authorization, is prohibited.

14. Applicable law and disputes

These General Terms and Conditions of Sale are governed by Irish law, subject to more protective mandatory provisions of the consumer's country of residence where applicable.

In case of difficulty or dispute, the customer is invited to contact Nidoulove first to seek an amicable solution.

Failing an amicable agreement, the dispute will be brought before the competent courts according to the applicable rules of law, without depriving the consumer of the mandatory rights they benefit from.
